Garment care

Some tips to keep your clothes always perfect!

- In the presence of color contrasts, it is advisable to wash the garment separately, respecting the temperature indicated on the label.
- Natural fabrics such as wool, linen, or silk shrink if washed at too high temperatures and can become distorted with spinning or if hung vertically.

SHIPPING AND RETURNS

The shipment of products is normally carried out via the best courier for the destination area, and may vary based on the type of item purchased.

A package tracking service is active for all available couriers.
The couriers make deliveries from Monday to Friday, during the hours of 10 am – 7 pm. The recipient cannot request delivery on specific days or times. In case of the recipient's absence, the courier will leave a notice of passage, via a label affixed to the residence. Delivery will be attempted twice: in case of failure, the courier will arrange to resend the package to Our headquarters.

To facilitate the resolution of the delivery process during the order, it is therefore essential:
1. Provide a correct contact number (landline or mobile).
2. Indicate a delivery address where someone is always present to collect the goods.
3. Always specify the surname on the intercom.

Brokeclothing.com will not be responsible for any malfunctions in the delivery service by the courier.

The courier notifies the customer via e-mail regarding the status of the shipment. The service is activated automatically if the field related to the e-mail address is filled out correctly.

"We invite you not to enter a PO BOX in the address field, as the courier would be unable to deliver the purchased goods. Therefore, a physical delivery address must be provided."

In the case of deliveries made at the reception/front desk (with a signature for receipt by the receptionist), Brokeclothing.com will not be held responsible for any subsequent failures to deliver the package to the final recipient.

If a destination country is not listed among those mentioned, it means that delivery of products to that country is currently not planned.

Shipping and Delivery

BRK SRLS ships to Europe and Italy via express courier.
BRK SRLS shall not be held responsible for delays in shipments caused by weather conditions, international customs issues, or other circumstances beyond its control.
Orders are processed for shipping from Monday to Friday 11:00-17:30 (CET). Orders placed from Friday to Sunday will be fulfilled the following Monday.

Orders related to available goods, subject to confirmation of the availability of the goods and verification of the bank transaction, are shipped the day after the order is received. The amount of transactions made with credit card is charged immediately at the moment the order is processed and following a verification of the transaction by the Bank. In all cases, BRK SRLS reserves the right to postpone the shipment if the order cannot be shipped for reasons beyond its control. Please note that during promotions and sales, shipments may be delayed.

Deliveries take place during office hours from Monday to Friday, excluding public holidays. The courier will make 2 delivery attempts; in case of failure, the order will return to our warehouse.
All orders are processed automatically by the system, so we are unable to modify shipping and delivery times.

Failure to deliver

If for any reason an order is not delivered due to lack of cooperation from the customer (incorrect phone number, incorrect address, missing address, failure to comply with import regulations), as per commercial agreements, the package may be returned to Italy at the Customer's expense, including import taxes. These expenses will be deducted from any potential refund.

Shipping methods and costs

Delivery times and shipping costs will vary depending on the type of shipment.
The following are the express couriers we use and the shipping times by geographical area:

Destination Italy:
- Standard shipping, 1-2 days
- Express, the following day

Destination Europe:
- Standard shipping, 2-3 days
- Express 1-2 days

Italy standard shipping (2 – 3 days), free for orders over 140 EUR), cash on delivery has an additional cost of 5 EUR.
Europe and Europe Extra CEE (Free for orders over 200 EUR)
Standard (2 – 3 days) 15 EUR

In Italy, delivery takes place within 24-48 hours, after 24 hours from the order registration date. For customized products, delivery may take one or two additional days. Any delivery delays may be caused by temporary unavailability of products, malfunctions in the courier service, force majeure, or during holidays. In case of non-delivery (excluding Saturday and Sunday), please contact customer service at the email address info@brokeclothing.com.

The delivery times for orders placed from Monday to Friday before 1:00 PM (CET) will be 2 working days for Express deliveries and 24 hours for Urgent delivery. In the case of orders placed after 1:00 PM (CET), on weekends, or on public holidays, delivery will take an additional day.

In Europe and the rest of the world, delivery occurs within 2-4 days, after 24 hours from the order registration date. For customized products, delivery may take one or two additional days. Any delivery delays may be caused by temporary unavailability of products, disruptions in service by the courier, force majeure, or during holidays. If the goods have not been received after 8 working days (excluding Saturday and Sunday), please contact customer service at info@brokeclothing.com.

Possible delays

Payments require an automatic verification from the Bank that issued the Credit Card, this verification may cause a delay in the shipment of orders.
Once authorized, the payment will be credited to the account of Brokeclothing.com and the order will be processed as quickly as possible.
Orders will be processed in chronological order, based on the time of receipt. Orders with "express shipping" have priority in processing over orders with "standard shipping." On weekdays (Monday to Friday), orders are processed within 24 working hours from the receipt of the order.

During specific times of the year, on holidays (when couriers do not make deliveries), and during peak order traffic times, which we have listed below, order processing times may be delayed by up to 3/4 days:

Home delivery

Check the status of your order at any time by entering the "My Orders" section in My Account. If you have not registered on Brokeclothing.com, you can do so at any time by entering the same email used at the time of the order.

Anyway, when your order has left our warehouses, we will send you a confirmation email of the shipment.

Customs duties and taxes

In the case of shipping addressed to a country that is not part of the European Union, the goods may be subject to customs duties and any sales taxes. Any additional charges related to customs clearance will be solely the responsibility of the recipient.

In case of refusal of the goods by the customer or failure to deliver for other reasons (e.g. incorrect address and/or phone number of the recipient; repeated absence of the recipient, etc.), the amount will be withheld to cover the following expenses: "shipping of goods" + "return of goods" + "customs for return" and charged to the recipient. The price of the goods will instead be refunded.

Customs duties and any applicable taxes vary based on the destination country and are applied upon the arrival of the goods in that country. For information regarding the amount of duties and any applicable taxes, as well as the customs clearance procedures for the goods, it is advisable to contact the relevant Customs Offices of the destination country.

RETURNS AND REFUNDS

Right of withdrawal

You have the right to withdraw from the contract within 14 days. The withdrawal period expires 14 days from the day you or a third party, other than the carrier and designated by you, take physical possession of the purchased Item. If you have purchased multiple Items with a single order, the withdrawal period expires 14 days from the day you or a third party, other than the carrier and designated by you, take physical possession of the last Item.

To exercise the right of withdrawal, you are required to inform us via email at the address info@brokeclothing.com of your decision to withdraw from the purchase contract through an explicit statement. For this purpose, you can use the standard withdrawal form attached as Annex 1 to these General Conditions, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient to send the communication regarding the exercise of the right of withdrawal before the expiration of the withdrawal period. Upon receiving the withdrawal request, we will send you a confirmation of receipt via email.

In the event of withdrawal from the purchase contract, you will be refunded all payments you have made in our favor, (except for shipping costs and additional costs resulting from any choice of a delivery method different from the standard one we offer), without undue delay and in any case no later than 14 days from the day we receive your withdrawal request. Such refunds will be made using the same payment method you used for the original transaction, unless you have expressly agreed otherwise; in any case, you will not incur any costs as a result of such a refund.

If you have exercised the right of withdrawal regarding the purchase of an Item, unless we offer to collect the Item, please return the Item to us or deliver it to us without undue delay and in any case within 14 days from the day you communicated your withdrawal from the purchase contract. The deadline will be considered respected only if the Items are returned before the expiration of the 14-day period. In the event of exercising the right of withdrawal from the purchase of Articles, the refund may be suspended until the Articles are received or until you have provided proof of having returned the Articles, whichever is earlier.

You will be held responsible only for the decrease in value of the Articles resulting from a manipulation of the Articles other than that necessary to establish the nature, characteristics, and functioning of the goods.

You are required to return the Articles in their original condition with warranty seals and original labels not removed. The packaging of the Articles must be careful to protect the original containers from damage, writing, or labeling.

The right of withdrawal is excluded, in particular, in the following cases provided for by the Consumer Code:

a) the supply of goods made to measure or clearly personalized;

b) the supply of sealed goods that are not suitable for return for hygiene reasons or related to health protection and have been opened after delivery. Therefore, for hygiene reasons, for example, slips, thongs, and panties are provided with a protection system that prevents them from being tried on or used. Instructions

If you are not satisfied with the item purchased on Brokeclothing.com, you have 14 days from the receipt of the order to exchange it for one in a different size or color, or to request its return. It's super easy!

Send an email to info@brokeclothing.com specifying whether you wish to make an exchange or a return. Brokeclothing.com reserves the right to request, if deemed necessary, a photograph of the product to verify its condition in order to accept or not the return.

If possible, use the original packaging, and attach the previously printed delivery note. The courier will come to your home to collect the package: We will send you an email to confirm a date and time slot for the collection of the items. In case of a return, the refund will be processed using the same payment method as the purchase within 3-12 working days from the date of receipt of the package at our warehouses.

Conditions in case of withdrawal

When you exercise the right of withdrawal, you should know that:

Returned items must not have been damaged. The security seal and original labels must be intact; otherwise, the return will not be accepted. The right of withdrawal does not apply: in the case of (a) supply of goods made to measure or clearly personalized (including the customized items referred to in the previous art. 4.12); (b) supply of sealed goods that are not suitable for return for hygiene or health protection reasons and have been opened after delivery. Legal Guarantee

The Articles sold on the Site to users acting as consumers (i.e., for purposes unrelated to any entrepreneurial, commercial, artisanal, or professional activity that may be carried out) are covered by the legal warranty of conformity referred to in Articles 128-135 of the Consumer Code.

There is a lack of conformity in the case where:

a) the article is not suitable for the use for which goods of the same type are usually intended;
b) the item does not conform to the description we made on the Site and does not possess the qualities of the good we presented to you;
c) the article does not have the usual quality and performance of a good of the same type, which you can reasonably expect, taking into account the nature of the article and, if applicable, the public statements regarding the specific characteristics of the article made by us on the Site, by the manufacturer or by its agent or representative, particularly in advertising or on the labeling;
d) the article is not suitable for the particular use you intended, which was brought to our attention at the time of the conclusion of the contract and which we accepted also through conclusive facts.
You can request, at your choice, to repair an item or to replace it, at no cost in either case, unless the requested remedy is objectively impossible or excessively burdensome compared to the other. You can request, at your choice, a reasonable reduction in the price or the termination of the contract in the event of one of the following situations: (i) the repair and replacement are impossible or excessively burdensome; (ii) we have not carried out the repair or replacement of the item within a reasonable time; (iii) the previously carried out replacement or repair has caused you significant inconvenience.

Reimbursement

The refund times range from 3 to 12 working days from the moment we receive the returned goods at our warehouse. After acceptance, we will immediately request the refund and send a confirmation email. The refund will be processed using the same payment method used during the purchase.

The refund times vary based on the chosen payment method:
Credit Card: our bank will process the refund within 7 working days from the Confirmation of Return Acceptance email. The time required to see the refund in your account depends on the card issuing institution.
PayPal: the refund will be visible in the PayPal account within 24 hours from the Return Acceptance Confirmation email.
Cash on delivery: the refund will be made via bank or postal transfer to an account to be indicated during the return procedure. An amount of 5 Euros, equal to the cost of the "cash on delivery" service, will be deducted from the refunded amount; the sum will be visible on the bank statement within 10 working days from the Confirmation of Return Acceptance email.

If you decide to return an item using a shipping method of your choice, without using our free item pickup service, the shipping costs for returning the item that you incur will be your responsibility.

Charges on the Credit Card
If the existing funds are sufficient for the purchase and the provided bank details are valid, the transaction will be processed instantly.
